National Human Rights Commission criticizes caning proposal

The National Human Rights Commission is criticizing a referendum proposal on
judicial caning.

The proposal was initiated by the K-M-T and asks votes if they agree that
caning should be imposed by courts for sexual assault, child abuse,
high-value fraud and aggravated fraud involving multiple forms of fraud, in
order to deter crime?"

The commission says judicial caning violates international human rights
standards enshrined in Taiwan's legal system.

It further adds that while it understands public concerns over serious crimes
and the need to strengthen crime prevention, criminal policy should be based
on constitutional and human rights principles as well as scientific evidence.

The commission also says caning constitutes corporal punishment involving
elements of humiliation and degradation, making it incompatible with
protections under the United Nations' International Covenant on Civil and
Political Rights.

The referendum proposal is one of three that have been approved by the
Legislative Yuan.

The other two referendum proposals to have been pased concern the use of
traffic fines and the abolition of the non-nuclear energy policy.
