In its first ruling in over a year, the constitutional court announced that the legislative process for amending the Constitutional Court Procedure Act had significant flaws and violated due process.
That makes the amendments invalid.
That's after the legislative yuan almost one year ago passed amendments to the act, stating that the court must have at least 10 ot of 15 justices present to hear a case...
after 7 justices stepped down a few months prior.
After passing these amendments, the legislature refused to confirm any of President Lai's 14 nominees to fill the vacancies.
The Executive Yuan passed a motion for reconsideration early this year... but the reconsideration was rejected by the KMT and TPP's legislative majority.
Today's judgment was made by 5 of the 8 remaining justices...
but the 3 others say that the constitutional court was not fit to operate, and that therefore the judgement is invalid.
