Opposition lawmakers propose Control Yuan impeach Premier over fiscal law

The Legislative Judiciary and Organic Laws Committee has voted to call on the Control Yuan to initiate impeachment proceedings against Premier Cho Jung-tai over his refusal to countersign the Act Governing the Allocation of Government Revenues and Expenditures.
The censure was proposed by K-M-T lawmakers Lo Chih-chiang and Wang Hung-wei and Taiwan People's Party chairman and lawmaker Huang Kuo-chang.
According to the three lawmakers, under longstanding interpretations by the Constitutional Court, Article 37 of the Constitution serves as "a check on presidential authority."
They say both the Premier and President Lai Ching-te "distorted the constitutional meaning of Article 37" by refusing to enact and countersign the Act ...
.. and the three lawmakers argue that the if the executive branch can "arbitrarily overturn laws" passed by the Legislative Yuan and "usurp the judicial power to decide constitutionality," the principle of separation of powers would collapse.
Prior to voting on the proposal, the committee invited Cabinet Secretary-General Xavier Chang as well as officials from the Judicial Yuan and Ministry of Justice, to give a special report on constitutional issues arising from the Cabinet's response to the amendments.
The Legislative Yuan will now submit the committee resolution to the Control Yuan.
